Equality and MMDA =yls
All men and women are equal as human beings but all men and women are not equal in several respects. There is inequality among them.
All men are equal as human beings but all men are not equal in several respects. There is inequality among them.
All women are equal as human beings but all women are not equal in several respects. There is inequality among them.
This is why the concepts of ‘ formal equality’ and ‘substantive equality’ have evolved to address these inequalities, which affirms the fact that there exist inequalities among human beings.
Now the question is who knows these inequalities better. The Creator? Or the creation?
Shariah Law is based on the dictates of the Creator. Can those who believe in the Creator and his Religion talk anything outside the Creator’s dictates and claim to be followers of his Religion?
It is agreed that the MMDA is not pure Shariah Law in respect of Muslim marriages and reforms thereto are not objected to, so long as they are within the bounds of his dictates. On what basis do they bring the Western concept of human rights, and the concept of equality enshrined in the Constitution which concept is based on the so called Universal Human Rights? ( if time permits I will write a detailed article on whether the so called Universal Human Rights are really so, Insha Allah).
Are the Muslim Personal Law Reforms Groups and others who talk about Constitutional provisions on equality ignorant of Article 16(1), which is mainly meant to protect the personal laws notwithstanding their inconsistencies with the provisions of the Constitution?
In conclusion, what is attempted to be emphasized here is that MMDA could be subjected to reforms provided that they are within the bounds of Islam. As agents of Western Interests, any reforms suggested to MMDA outside Islam cannot be accepted.
The so called Muslim women groups!!! Most of you are, either for some personal Benefits or due to your ignorance not only humiliating Islam but also drawing innocent muslims away from Islam very often in the name of reforms to MMDA.
Please note that anyone who is dissatisfied with MMDA can very well contract his or her marriage under the General Law (and nothing prevents them from doing so) rather than amending the MMDA to be in line with the General Law. MMDA IS MEANT FOR MUSLIMS WHO WANT TO CONTRACT THEIR MARRIAGES IN LINE WITH THE DICTATES OF THE CREATOR AND NOT IN LINE WITH WHIMS AND FANCIES OF THE CREATION.
Those who advocate “ One Law and One Country Concept”!!! You are in effect calling for assimilation instead of integration. Assimilation has never been successful anywhere in the World.
So, don’t destroy integration of the different Communities!
